Title XXIX: Crimes – Procedures
Chapter 2907 – Sexual Offenses

Sexual conduct: vaginal, oral, or anal penetration.

Sexual contact: any touching of an erogenous zone, such as genitals, pubic area, thighs, buttocks, for the female: breasts, for the purpose of sexual arousal.

Elements of Rape: To engage in sexual conduct
(a) with another by purposely compelling submission by force or threat of force
(b) for the purpose of preventing resistance, offender substantially impairs victim’s judgment or control by administering any drug or intoxicant secretly, by force, or by threat of force […]
(d) when victim’s ability to resist or consent is impaired because of mental or physical condition.

THE VICTIM NEED NOT PROVE PHYSICAL RESISTANCE
